Das Recht des geistigen Besitzes macht wieder einmal von sich reden in der internationalen Szene. Ein Jahr nach der diplomatischen Konferenz in Genf, die unter der Schirmherrschaft der World Intellectual Property Organization stand, hat soeben die Europäische Kommission ihren « Vorschlag einer Direktive über die Harmonisierung gewisser Aspekte des Urheberrechts und verwandter Rechte in der Informationsgesellschaft » zur Kenntnis gebracht. Dieser Text gibt zum ersten Mal eine vollstandige Definition der zwei wichtigsten Komponenten des Urheberrechts, des Reproduktionsrechtes und des Rechtes der Mitteilung an die Öffentlichkeit und bemüht sich, sie im wesentlichen an die neue elektronische Umgebung anzupassen. Die Festlegung solcher Rechte hat eine strategische Bedeutung, sowohl für die Rechtsinhaber als auch für die Nutzniesser. Sie regelt die zukünftigen Gebrauchsbedingungen der Werke in den Netzen und bestimmt das Kräftespiel zwischen den verschiedenen Akteuren der Informationsgesellschaft.

Property rights are once more found before the international scene. One year after the Conférence diplomatique de Genève which took place under the auspices of the World Intellectual Property Organization, the European Commission has recognized its « proposition for the directive on the harmonization of certain aspects of author's rights and related rights in the information society ». A keystone of Community legislation in the area of intellectual property, this text gives, for the first time, a complete definition of the two major components of the author's rights, the right of reproduction and the right of communication to the public, and endeavours to adapt these to the new electronic environment. Is there still a need to underline at what point the definition of such rights is strategic as much for the holders as for the users? It governs the future methods of utilization of works on the network and designates the strength of relations between the different participants in the information society.

Le droit de la propriété intellectuelle se trouve une nouvelle fois porté sur le devant de la scène internationale. Un an après la conférence diplomatique de Genève, qui s'était tenue sous les auspices de l'Organisation mondiale de la propriété intellectuelle, la Commission européenne vient de faire connaître sa « proposition de directive sur l'harmonisation de certains aspects du droit d'auteur et des droits voisins dans la société de l'information ». Ce texte donne une définition complète des deux composantes majeures du droit d'auteur que sont le droit de reproduction et le droit de communication au public, et s'attache à les adapter au nouvel environnement électronique. Il s'agit d'une définition stratégique pour les titulaires et les utilisateurs, car elle conditionne les futurs modes d'utilisation des oeuvres sur les réseaux et dessine les rapports de force entre les différents acteurs de la société de l'information.
