- Résumé en allemand : Die Traditionen des Rechtes um den geistigen Besitz und die wirtschaftlichen Gegebenheiten sind verschieden für die Bibliotheken auf beiden Seiten des Atlantiks. Die Orientierung am « copyright » und das Gewicht der Erwerbungsbudgets erlauben den amerikanischen Bibliothekaren die zukünftige Organisation der Verteilung elektronischer Dokumente zu beeinflussen. Das Urheberrecht und die bescheidene Rolle der französischen Bibliotheken als Kunden der Verlage führen im Gegensatz zu Debatten und einer zunehmenden Verständnislosigkeit in Bezug auf die gegenwärtige Situation. Die Unterzeichnung der Berner Konvention und die europäische Harmonisierung eröffnen den französischen Bibliothekaren neue rechtliche Perspektiven, wenn sie die günstige Gelegenheit zu nutzen wissen, die sich bietet.
- Résumé en anglais : The traditions of intellectual property rights and the economic stakes are different for libraries on either side of the Atlantic. The orientation towards the publication of copyright and the importance of acquisition budgets permit American librarians to have an influence on the future organization of the distribution of electronic documents. The rights of the author and the modest role of French libraries in the economics of publishing lead, on the contrary, to debates and misunderstandings in relation to the current stakes. The signing of the Berne Treaty and the European harmonization opens up the new legal perspectives for French libraries, if they know how to take hold of the opportunities which present themselves.
- Résumé : Les traditions du droit de la propriété intellectuelle et les enjeux économiques sont différents pour les bibliothèques des deux côtés de l'Atlantique. L'orientation vers la publication du copyright et l'importance des budgets d'acquisition permettent aux bibliothécaires américains de peser sur l'organisation à venir de la distribution des documents électroniques. Le droit d'auteur et la modestie de la place des bibliothèques françaises dans l'économie de l'édition conduisent, au contraire, à des débats et à des incompréhensions, en décalage par rapport aux enjeux actuels. La signature du traité de Berne et l'harmonisation européenne ouvrent des perspectives juridiques nouvelles aux bibliothécaires français, s'ils savent saisir les opportunités qui se présentent.
