Das Gesetz das in Italien intellektuelles, künstlerisches und literarisches Eigentum regelt, beruht auf dem Urheberrecht im Gegensatz zu dem angelsächsischen Copyright. Es wurde 1941 eingeführt und seitdem mehrmals geändert, vor allem im Jahr 2000. Die EU-Urheberrechtsrichtlinie vom Mai 2001 über die Harmonisierung von verschiedenen Aspekten des Urheberrechts und verwandter Rechte in der Informationsgesellschaft wurde in 2003 erweitert und stellt die weitaus wichtigste Gesetzesänderung auf dem Gebiet dar. Darüber hinaus sieht sie eine Liste möglicher Ausnahmen vor, die vom italienischen Gesetzgeber nicht angenommen wurden.

The law which regulates intellectual property, artistic and literary, in Italy is based on the law for authors' rights, in contrast to the Anglo-Saxon law of copyright. Adopted in 1941, it has undergone a number of modifications, in particular in 2000. The European directive of May 2001 on the harmonization of certain aspects of authors' rights and neighbouring rights in the information society was transposed in 2003, and constitutes the most important legislative development in the field. It provides for a list of possible exceptions which the Italian legislator has chosen not to adopt.

La ley que regula la propiedad intelectual, artística y literaria en Italia está fundada en el sistema del derecho de autor, en oposición al copyright anglosajón. Adoptada en 1941, ésta ha sufrido numerosas modificaciones, en particular en el 2000. La directiva europea de mayo del 2001 sobre la armonización de ciertos aspectos del derecho de autor y de los derechos vecinos en la sociedad de la información ha sido transpuesta en el 2003 y constituye el más importante ordenamiento legislativo en la materia. Esta prevé una lista de excepciones posibles que el legislador italiano ha elegido no adoptar.

La loi qui régule la propriété intellectuelle, artistique et littéraire en Italie est fondée sur le système du droit d'auteur, par opposition au copyright anglo-saxon. Adoptée en 1941, elle a subi de nombreuses modifications, en particulier en 2000. La directive européenne de mai 2001 sur l'harmonisation de certains aspects du droit d'auteur et des droits voisins dans la société de l'information a été transposée en 2003 et constitue le plus important réaménagement législatif en la matière. Elle prévoit une liste d'exceptions possibles que le législateur italien a choisi de ne pas adopter.
