Das Gesetz, welches die europäische Richtlinie 2001/29/CE vom 22 Mai 2001 zur Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft in belgisches Recht umsetzt, trat im Mai 2005 in Kraft. Es nimmt zur Frage der öffentlichen Ausleihe Stellung und unterbricht die unterschwellige Debatte im Umfeld öffentlicher Bibliotheken, deren Besonderheit nicht Rechnung getragen wurde.

The Law which transposes into Belgium law the European directive 2001/29/CE of 22 May 2001 on the harmonization of certain aspects of authors' rights and neighbouring rights in the information society was promulgated in May 2005. It takes a stand on the question of public lending and this has caused commotion in the latent debate in the world of public libraries, where their specificity has not been taken into consideration.

La Ley que transpone en derecho belga la Directiva europea 200 1h/29/CE del 22 de mayo del 2001 sobre la armonización de ciertos aspectos del derecho de autor y de los derechos vecinos en la sociedad de la información fue promulgada en mayo del 2005. Esta toma posición sobre la cuestión del préstamo público y desencadenó un debate latente en el mundo de las bibliotecas públicas cuya especificidad no fue tomada en cuenta.

La Loi transposant en droit belge la Directive européenne 2001/29/CE du 22 mai 2001 sur l'harmonisation de certains aspects du droit d'auteur et des droits voisins dans la société de l'information a été promulguée en mai 2005. Elle prend position sur la question de prêt public et a fait éclater un débat latent dans le monde des bibliothèques publiques dont la spécificité n'a pas été prise en compte.
